Eve Hill was quoted as a legal authority in a Law360 story about a U.S. Department of Labor proposal to eliminate the subminimum wage for workers with disabilities. 

The future of the Fair Labor Standards Act’s Section 14(c) is uncertain, as Republicans remain divided on the issue. If the proposal were to pass, it would end employers paying below minimum wage to workers with disabilities.

“The opposition to Section 14(c) really crosses party lines,” said Eve in the article. “It’s not a political issue, and it’s not something that any in the new administration have made promises about.”

The comment period for the proposal closed January 17, and it is now up to the Trump administration to finalize the rule. Eve discussed the potential future of the proposal.

“It could get held up in just a flat, nonregulation approach to governing, which the Trump administration has expressed,” said Eve. “The Republican Congress may take a similar view in conducting its Congressional Review Act work.”

Eve has expressed her stance that it is critical that people with disabilities are treated equitably in their communities, including equitable opportunities for fair labor and real jobs.

“Now is the time for us – all of us – to work to end subminimum wages once and for all,” Eve wrote in a previous blog article on the topic.
